For any dispute with Bublédon, you agree to first contact us and attempt to resolve the dispute with us informally by sending an email to legal@bubledon.com. You must include your name, your residence address, the email you used in Bublédon User Account, the facts and circumstances of the Dispute. Both parties agree to make good faith efforts to resolve any claims, dispute, disagreement directly. Ifunlikely, the parties do not reach an agreement to do so within thirty (30) days, you or Bublédon may commence an arbitration proceeding. All arbitration shall be conducted by the American Arbitration Association (“AAA”) pursuant to its Consumer Arbitration Rules (“AAA Rules”), as modified by these Terms. The AAA Rules are available on the AAA’s website adr.org, or by calling the AAA at 1-800-778-7879. All arbitration proceedings between the parties will be confidential unless otherwise agreed by the parties in writing.

YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS, YOU AND BUBLÉDON ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, PRIVIATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING OF ANY KIND.

Nothing in this Section shall be deemed as preventing or limiting the right of either party from seeking injunctive relief from the courts as necessary to prevent the actual or threatened infringement, intellectual property claims or bring individual action in a small claim court. In addition, you have the right to opt-out of the provisions of this Section by sending written notice of your decision to opt-out by emailing us at legal@bubledon.com. The “Opt-out Notice” must be sent within thirty (30) days that you agree to these Terms, otherwise, you shall be bound to arbitrate disputes in accordance with the terms of this Section. We, Bublédonalso will not be bound by these terms if you opt-out of these arbitration provisions.

If any provision of this arbitration agreement set forth in this Section is deemed invalid or unenforceable, it will be severed from this Section, and the remaining arbitration terms will be enforced.
SECTION 17 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
